Charon Reports on the Geert Wilders affair...
Today I am talking to Carl Gardner, barrister, writer, ex government lawyer and author of the Head of Legal blog about the possibly unlawful exclusion of Geert Wilders.
Wilders has been excluded under regulations 19(1) and 21 of the Immigration (European Economic Area) Regulations 2006, which faithfully copy out and implement the requirements of article 27 of Directive 2004/38 on the rights of EU citizens to move freely.

The Guardian reported this morning: " Geert Wilders, the rightwing Dutch politician accused of Islamophobia, was today refused entry to the UK after arriving at Heathrow airport in London. Wilders was due to show his 17-minute film Fitna, which criticises the Qur'an as a "fascist book", at the House of Lords today. But on Tuesday he received a letter from the Home Office refusing him entry because his opinions "threaten community harmony and therefore public safety". He arrived at Heathrow shortly after 2pm and was questioned by immigration officials. On the plane from Amsterdam, the controversial leader of the Freedom party told Dutch journalists he had travelled to Britain in December without any fuss. "I don't see why there's a problem with me this time," he said. "I don't understand why they allowed me to come before and not now." Asked whether he had a message for the UK government, he said: "I would say to them, 'Even if you don't like me and don't like the things I say then you should let me in for freedom of speech. If you don't, you are looking like cowards.'"
The Times stated this morning….
"The right to oppose, mock, deride and even insult people's beliefs is essential to a society where bad ideas are superseded by better ones. There is no right to have one's emotional sensibilities protected, for it is no business of government to legislate for people's feelings. Mr Wilders' views are obnoxious, and (not but) his freedom to express them must be defended."
Guido Fawkes has a very interesting condemnation of the failure ofpoliticans to stand up for freedom of speech on his blog

"Political professionals have little time for activist true believers and their pesky principles. Freedom of speech is one of those fundamental principles in a free democracy. It requires that you especially defend the rights of those with whom you disagree. Guido has gone to the trouble of watching the Fitna video, it contains no call to violence, in fact it condemns violence.
In the past and at great cost diplomatically, a Conservative government defended Salman Rushdie's freedom of speech. It is therefore profoundly disappointing that the Tories have chosen to be officially agnostic about Geert Wilders. The decontamination strategy has turned into moral cowardice.
